These Terms & Conditions ("Terms") govern your access to and use of Affinity Cardworks (the "Site"), operated by Affinity Cardworks ("we," "us," or "our"). By accessing or using the Site, including by confirming that you are 18 or older at our entry prompt, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

1. Eligibility and age requirement

The Site contains mature, adults-only content and is intended solely for persons who are at least 18 years old (or the age of majority in your jurisdiction, if higher). By using the Site you represent and warrant that you meet this requirement and that it is lawful for you to view adult content where you are located. We may use location signals and other measures to restrict access where required by law, but you remain responsible for compliance with the laws that apply to you.

2. Nature of the content

All artwork displayed on the Site is original, illustrated and fictional work produced by the Site's sole creator. The Site does not host, and does not permit, photographic, "realistic," or real-person imagery of any kind. Nothing on the Site is intended to depict, and nothing on the Site does depict, any real individual.

Every character that appears in any mature or sexual context is a wholly fictional adult who is 18 years of age or older. Characters are creative inventions; they are not real people, are not based on real people, and do not represent or correspond to any actual minor. We do not create or permit any depiction of a minor in a sexual context. Because the works are original illustrations of imaginary adults, they do not depict real persons of any age; United States courts have recognized that purely fictional, illustrated depictions are not records of, and do not involve, any real person.

3. Records-keeping statement (18 U.S.C. § 2257)

All content on the Site consists exclusively of original fictional illustrations. The Site does not contain, and is not a producer (primary or secondary) of, any visual depiction of an actual human being engaged in actual or simulated sexually explicit conduct. Because no real persons are depicted, the record-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 do not apply. All characters depicted are fictional and are represented to be adults aged 18 or older.

4. Intellectual property

All content on the Site, including illustrations, designs, card artwork, text, logos, and layout, is owned by Affinity Cardworks or its licensor and is protected by copyright and other intellectual-property laws. You are granted a limited, personal, non-commercial, revocable licence to view content on the Site. You may not copy, reproduce, download (except where a download is expressly offered to you), redistribute, sell, publicly display, create derivative works from, or use any content to train machine-learning or AI systems, without our prior written permission. Characters and other third-party properties depicted in the artwork remain the property of their respective owners; the artwork is original fan-created illustration.

5. Accounts

Some features require an account. You agree to provide accurate information, to keep your credentials secure, and to be responsible for activity under your account. By registering you reaffirm that you are at least 18 years old. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are used unlawfully.

6. Acceptable use

You agree not to:

access the Site if you are under 18 or where adult content is unlawful;
scrape, harvest, or bulk-download content, or circumvent access or security controls;
reproduce or redistribute content, or use it commercially, without permission;
use the content to train or develop AI/machine-learning models;
upload malicious code, or attempt to disrupt or gain unauthorized access to the Site;
misrepresent your age, location, or identity to gain access.

7. Purchases, products, and payment

The Site may offer physical and/or digital products for sale. Where it does: prices, availability, and product descriptions may change at any time and may contain errors, which we may correct. Payments are processed by a third-party payment processor; we do not receive or store full payment-card details (see our Privacy Policy). Because of the nature of the content, payment services are provided by a specialized ("high-risk") processor, and your payment is also subject to that processor's terms. Orders are not accepted until payment is authorized.

Shipping and handling. Physical orders are typically handled (prepared and dispatched) within two (2) business days of payment, unless we indicate a different timeframe in advance via an announcement on the Site (for example, during holidays or high-volume periods). We ship via UPS, FedEx, or the United States Postal Service (USPS) at our discretion. Delivery timeframes once a parcel is in the carrier's hands are estimates and are not guaranteed.

Sales tax. We collect and remit sales tax as required based on the destination state and applicable law. Any tax is shown at checkout.

Chat credits. The Site offers "chat credits," a virtual, prepaid balance used to access AI-assisted chat and roleplay features. Credits may be obtained by purchase or granted with certain products or promotions. Credits are a limited, personal, non-transferable licence to use those features — not money, legal tender, or a stored-value or gift-card instrument — and they have no cash value and cannot be redeemed for cash. Credits are consumed as you use the chat features, at rates we set and may change; usage typically scales with the length of the conversation and the responses generated. We may change credit prices, pack sizes, grant amounts, and consumption rates at any time, but a change to consumption rates will not retroactively alter credits already spent. Credits are tied to your account, are not redeemable across accounts, and any balance is forfeited if your account is terminated for violation of these Terms. AI-generated chat output may be inaccurate or not to your expectations; it is provided as-is and does not entitle you to a refund of credits consumed. We confirm each credit purchase before it is placed and credits are added to your account once payment is confirmed.

8. Returns, refunds, and cancellations

We care about customer satisfaction. For physical goods, you may request a return or replacement within fourteen (14) days of delivery. If an item arrives damaged, defective, or not as described, we will replace it or refund it at your choice. To start a return, contact us through the contact channels on the Site with your order details.

Digital downloads, where offered, are delivered immediately and are non-returnable once accessed, except where the file is defective or the law requires otherwise. If you believe a charge is incorrect, please contact us before initiating a chargeback so we can make it right.

Chat credits are non-refundable once they have been added to your account, except where the law requires otherwise. Credits already consumed cannot be refunded or restored. If credits were not added after a confirmed payment, or you believe a credit charge is incorrect, contact us before initiating a chargeback and we will make it right.

9. Enforcement and termination

We may, in our sole discretion and without notice, restrict, suspend, or terminate your access to all or part of the Site, including by blocking IP addresses, if we believe you have violated these Terms or used the Site unlawfully. We may also modify or discontinue the Site, or any part of it, at any time. Provisions that by their nature should survive termination (including intellectual-property, disclaimer, liability, and indemnification provisions) will survive.

10. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the fullest extent permitted by law, Affinity Cardworks will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Site. Our total liability for any claim relating to the Site or your purchases will not exceed the greater of the amount you paid us in the twelve (12) months preceding the claim or one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless Affinity Cardworks from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

13. Copyright complaints (DMCA)

We respect intellectual-property rights. If you believe in good faith that content on the Site infringes your copyright, you may send a notice under the Digital Millennium Copyright Act ("DMCA") through the contact channels on the Site. Your notice should include:

your physical or electronic signature;
identification of the copyrighted work you claim has been infringed;
identification of the material claimed to be infringing and where it is located on the Site;
your contact information (name, address, email);
a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and
a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the owner's behalf.

We will respond to valid notices promptly and may remove or disable access to the material in question. Complaints about non-copyright matters (such as trademark or privacy) may be submitted the same way with a description of the issue and its location on the Site.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

15. Governing law and venue

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Site or these Terms may be brought only in the state or federal courts located in Michigan, and you consent to the exclusive jurisdiction and venue of those courts. Nothing here prevents us from seeking injunctive relief to protect our intellectual property in any appropriate court.

16. General

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede prior agreements on that subject. No partnership, employment, or agency relationship is created by these Terms.
